The Fair Housing Act (42 U.S.C. 3604)

Under federal housing law, it is illegal for property managers, landlords, and homeowners associations (HOAs) to discriminate against tenants with disabilities who rely on emotional support animals for daily functioning.

1. Complete Exemption from Pet Fees & Rent

Landlords are strictly prohibited from demanding initial pet fees, monthly pet rent, or additional pet security deposits for verified assistance animals.

2. Overriding "No-Pets" Building Clauses

Even if a lease states "No Pets Allowed", federal law supersedes building rules to permit emotional support companions.

3. Immunity from Breed & Weight Restrictions

Property managers cannot deny an ESA based on breed (e.g. Pitbulls, Rottweilers) or weight limitations.
